Where Do You Sue?

Do you sue in the jurisdiction where the debtor is? Or sue pursuant to the venue clause and/or home state and then domesticate where the debtor is? We will discuss  Venue Clauses, Foreign State Judgment Domestication, and cost-benefit analysis to making the best business decision.

TIMOTHY WAN was admitted to the New York State Bar in January 2001, after graduating from Brooklyn Law School with his Juris Doctor in June 2000 and from Vassar College with a double B.A. in Political Science and Theatre in May 1997.


Mr. Wan is the Principal Owner of Smith Carroad Levy & Wan, and is retained as outside General Counsel to various small businesses in the local business community. Mr. Wan manages the creditor’s rights and collection law practice and spearheads the practice in the area of entertainment law, copyright, and intellectual property.

Mr. Wan is admitted to the United States District Court for the Southern and Eastern Districts, and a member of the New York State and Suffolk County Bar Associations. Mr. Wan is a Past Chair of the Eastern Region of the Commercial Law League of America, a Past Chair of the CLLA Young Member's Section, and a past member and Recording Secretary of the Board of Governors. He has also served as the President of the Commercial Lawyers Conference of New York since January 2011. Mr. Wan is a published author of the New York chapter of the textbook, Judgment Enforcement published by Aspen Publishing. Mr. Wan is also a featured columnist and on the Board of Associate Editors for Commercial Law World. Mr. Wan is an active member and past president of the Infinite Exchange Chapter of BNI, a member of the National Association of the Remodeling Industry, and a member of the International Association of Commercial Collectors.
