E - Discovery 101

Given the electronic age in which we are living (where many, if not most, of the documents and information subject to discovery are in electronic form), the changes to the Federal Rules of Civil Procedure and the proliferation of new local rules and guidelines governing discovery of electronically stored information (ESI), every lawyer should have a basic understanding of the manner in which ESI is kept and stored and the requirements for preserving and producing it in discovery. Moreover, many of the state bar ethical rules now, directly or indirectly, require that a lawyer have an understanding of electronic discovery as part of a lawyer’s duty of competence. “Electronic Discovery 101” will provide an overview of relevant issues and discuss helpful resources for further reference.
