I am so excited to be the League President this year. The volunteers and staff who make the League what it is, are working hard to set up an amazing 2025. As League President, it is my pleasure to let you know about some of the excitement that is happening in your League. I also want you to know that it is my goal to see you thrive in your business and practice. It is also my goal to see you thriving in business because it’s coming through your relationship with the League and its members.
I have had so many new and older members say they want to know how to get business out of the League. Well, the answer is simple, NETWORK. The League offers so many ways to network both in person and online via Zoom whether it be a conference, convention, committee, region, section, education, or open discussion meetings. They are all a great way to see others in the League, meet and be involved.
The 2025 National Convention is May 14-16 in Chicago at the incredible Swissotel. If you know me, then you know I’m a hotel snob! I must say this venue, its location and the rooms are some of the best in Chicago. You will not want to miss it. The National Convention is a great place to network. If you are a new member, we have a new member event and other just for you. We also have some special social events planned this year. Please take some time and read through this Attendee Guide for all meeting details.
Don’t miss our Southern Regional Conference, February 14-16 in New Orleans. If you have not yet registered, visit this link. This smaller conference will give you a great opportunity to meet folks that will also be in Chicago, so I encourage you to register. If you have ever wanted to visit New Orleans, this is the time. For those of you that have always wanted to see a Mardi Gras parade, at 7 p.m. on the 14th, it’s the Krewe Boheme parade and at 6:30 p.m. on the 15th is the Krewe du Vieux parade… what happens in NOLA stays in NOLA!
If you’ve never participated in Hill Day, now is your chance to make a change. Hill Day is scheduled for March 2 – 4, 2025 in Washington, DC. Our Creditors Rights’ and Bankruptcy Sections will be meeting with legislative offices to discuss issues of importance to the League. Be sure to register for this event at https://clla.org/clla-hill-day-2025/.
The League will be launching an online community. This community will let you interact in real time with other members of the League about shared interests, goals or challenges. It will also allow for the creation of online groups based on League committees, regions and sections of the League. This launch will occur in the first quarter of 2025.
With all of this said, it continues to be my pleasure to serve as your League President. If I have never met you, please introduce yourself at a meeting. If you cannot make a meeting, give me a call. I personally want to ensure you are getting value out of your League membership. If you want to be more involved, I am always available to get you plugged into a committee or to help in some way. It is through your involvement that your professional practice will grow in the League. Come to meetings and network and you will see what I know: your business will expand, and you will find that some of your most lucrative matters come from League referrals.

A Message from League President Ted Hamilton about your Association the Commercial Law League of America.
I am so excited to be the League President this year. The volunteers and staff who make the League what it is, are working hard to set up an amazing 2025. As League President, it is my pleasure to let you know about some of the excitement that is happening in your League. I also want you to know that it is my goal to see you thrive in your business and practice. It is also my goal to see you thriving in business because it’s coming through your relationship with the League and its members.
I have had so many new and older members say they want to know how to get business out of the League. Well, the answer is simple, NETWORK. Joseph A. Marino is a Creditors’ Rights Specialist, initially certified by the American Board of Certification 1994. Mr. Marino obtained his BS in Commerce from St. Louis University, MO in 1971 and obtained his Juris Doctor from the New England School of Law in 1976. He is admitted to practice law in the states of New Jersey and Florida as well as the District of Columbia. He is a member of the American Bar Association, the Association of Certified Fraud Examiners, and the Commercial Law League of America. He has served the CLLA as its Secretary and as the Chair of its Creditors’ Rights Section. He is a frequent lecturer on creditors rights topics, including those focused upon fraud and fraudulent transfers. He contributes articles periodically to the Commercial Law World magazine of the CLLA. He is also an affiliate member of the Commercial Collection Agencies of America and the Marino, Mayers & Jarrach firm is an associate member of the International Association of Commercial Collectors. Mr. Marino established his firm as a full-service Commercial Litigation Firm, assisting clients throughout the State of New Jersey and the United States of America, to provide comprehensive, skillful, and cost-effective services to our clients. The firm prosecutes all Creditor Rights Claims: from general collections to more Complex Commercial Litigation including Fraud and Fraudulent Transfers, Bankruptcy, Replevin and RICO. Mr. Marino is also a member of the Unico Foundation, Confrerie de la Chaine des Rotisseurs and International Honor Society of the Sovereign Military Order of St. John of Jerusalem, Knights of Malta. In 2018, Mr. Marino received the “Robert E. Caine Award for Leadership” from the Commercial Law League of America.

While the law simmers on issues of interest to every chapter 11 practitioner and judge, this panel will delve deep into the tide and emerge with differing views of what the future holds based on recent Supreme Court cases such as Harrington v. Purdue Pharma LP; Truck Insurance Exchange v. Kaiser Gypsum; and a few oldies but goodies such as MacArthur Co. v. Johns-Manville Corp.
Fascinating philosophical and practical questions arise from Supreme Court jurisprudence on plan provisions that have come to be expected parts of chapter 11 plans. This panel will explore how that jurisprudence will impact plan provisions that we’ve come to expect as a traditional path to confirmation in chapter 11s. Regarding the releases, is an opt in or opt out sufficient for consent? Can non-voting creditors be “deemed” to have consented to such a release?
