This program examines the most common drafting and credit practice mistakes that quietly make debts uncollectible (from ineffective guarantees to poorly conceived venue provisions, to dispute resolution clauses that delay or outright impair recovery). They are routine issues that surface only when a claim is tested, often at the worst possible moment. Marc D. Wallick is the principal in the law firm of Wallick & Associates, Ltd., where he focuses his area of practice on collections, commercial and bankruptcy related matters. He received his B.A. degree from George Washington University, his M.B.A. degree from University of Miami and his J.D. degree from Suffolk Law School. Mr. Wallick has been a member of the Rhode Island and Massachusetts Bar Associations since 1978. He is also currently on the District Court Bench Bar Committee and the Creditors & Debtors Committee of the Rhode Island Bar Association. Mr. Wallick is a member of the IACC as well as the Commercial Law League of America where he has been a past Recording Secretary, Chairman of the New England District twice, as well as its Board of Governors. Mr. Wallick had served as a Chapter 7 panel trustee from 1988 to 2004. He has also been honored by his peers as being noted one of the top 50 attorneys in Rhode Island, as published in the Rhode Island monthly magazine in both 1998 and 2003 editions, under the category of collections, which is no longer a listed category. He has also lectured at the Rhode Island Bar Annual Meeting as well as at the CLLA conference. He has been married to his best friend, Bobbie, for over 47 years and has 3 children and 2 grandchildren for whom is very proud.

Legality and Enforcement of Electronic Transactions
The legal framework governing electronic signatures and electronic transactions has evolved rapidly since 2020. While the federal ESIGN Act and the Uniform Electronic Transactions Act (UETA) remain the foundation of electronic signature legality, states continue to update and reinterpret their own statutes. New York is the only state which has not adopted UETA. Instead, New York has the Electronic Signatures and Records Act. This program while focusing on the New York statute, will provide information on the E-Sign Act and UETA for those attorneys practicing in other states as well as New York. Recent judicial decisions that have clarified what constitutes a valid electronic signature, how consent to electronic contracting must be demonstrated, and the evidentiary standards courts apply when determining whether an electronic record is enforceable will be discussed.
This program provides a comprehensive understanding of the modern rules governing electronic transactions. Participants will learn how courts are currently evaluating electronic signatures, what technological and procedural safeguards companies must implement, and how to ensure that electronically executed commercial agreements are legally binding and defensible.

1936-2026
Warren Pinchuck, a man of extraordinary character, dedication, and warmth passed away on May 29, 2026, at the age of 89. A cornerstone of his professional community, Warren leaves behind a profound legacy of leadership and service that will be remembered for generations to come.
Throughout his distinguished career, Warren was a pillar of the Commercial Law League of America (CLLA). As a proud lifetime member, his commitment to the League went far beyond professional obligation; it was a true passion. Warren’s tireless devotion and selfless service served as a shining example to everyone who had the privilege of working alongside him. He approached every endeavor with a rare blend of thoughtfulness, an unmatched work ethic, and an unwavering spirit of volunteerism.
Because of his exemplarism, the Eastern Region established the Warren Pinchuck Service Award in his honor. This prestigious accolade is permanently bestowed upon Eastern Region members who embody the very qualities Warren championed throughout his life: leadership, integrity, and a selfless dedication to the League.
Warren’s passing is a monumental loss, but his spirit lives on in the organization he loved so dearly and in the countless lives he inspired. His memory will forever be a guiding light for future leaders, and his name will eternally stand as a synonym for excellence and service.

Michael A.
